A 28 year old Gweru man has been slapped with a 3 month prison term after being found guilty of culpable homicide as defined in section 49 section of the criminal law codification and reform act chapter 9:23.
It was state’s case that on 12 April 2021 at around 1755hours the accused Brighton Katsande Gwaza of 63 Chasina street Nehosho, who is a holder of a valid driver’s licence class 4 and 5 was driving a Toyota Mark X registration number AFA 5675 along Gweru-Zvishavane road heading towards Zvishavane without a passenger on board and upon reaching the 100km peg along the said road near Msipani turnoff the accused swerved off the road and hit a pedestrian Tanaka Munosiyai who was crossing the road.
He sustained severe head injuries and was taken to Zvishavane District hospital where he was pronounced dead by a medical practitioner. A Post mortem was conducted and the cause of death was determined to a head injury due to the road traffic accident.
The court heard that the accused person failed to keep a proper look out causing the accident and injuring the deceased who died as a result of injuries sustained.
Zvishavane magistrate Archie Wochiunga found the accused guilty as charged and sentenced him to 3 months in prison wholly suspended on condition of good behaviour.
The accused will do a 208 hours community service on Saturdays and Sundays at Senga Police station, Gweru and his license has been endorsed.
