A Texas judge has blocked the execution of Robert Roberson, 57, less than two hours before it was set to take place. Roberson, sentenced to death in 2003 for the death of his two-year-old daughter, Nikki Curtis, was the first person in the U.S. to face capital punishment over “shaken baby syndrome” charges.

Roberson and his legal team argue the child died from pneumonia complications, not abuse. However, prosecutors maintain that new evidence does not undermine their case, asserting the child’s injuries were caused by Roberson.
