A 26-year-old Zvishavane man will do community service after being found guilty of indecent assault as defined in section 67 of the Criminal Law Codification and Reform Act chapter 9:23.
The accused Audias Matumbura pleaded guilty to the charges of fondling 23-year-old Mellisa Ngaruze’s breasts without her consent when he appeared before the Zvishavane magistrate court.
It was the state’s case that on the 20th of December 2019 at around 2200hrs, the accused approached the complainant at Caravan Park with his friends and bought sadza.
She served them and the accused told her that she had given them a small portion. The accused then jumped over the counter went behind the complainant and fondled her breasts.
The court heard that on the 28th day of December 2019, the accused approached the complainant again and insulted her over the previous matter. The accused then again fondled the complainant’s breasts threatening to beat her up.
In his defense, Mutumbura told the court that he was under the influence of alcohol.
Zvishavane magistrate Archie Wochiunga found him guilty and sentenced him to community service.
